GENERAL TERMS AND CONDITIONS OF BUSINESS OF MESSE OFFENBACH GMBH FOR THE SALE OF TICKETS ON THE INTERNET

1. Field of application

1.1 These Terms and Conditions apply to contracts for the online ordering of admission tickets (hereinafter referred to as "Tickets") for the International Leather Goods Fair (here-inafter referred to as "ILM") and for the ILM VIRTUAL ORDER SHOW (hereinafter referred to as "ILMv") between the customer and Messe Offenbach GmbH (hereinafter referred to as "Messe Offenbach").

1.2 By ordering the online ticket, the customer accepts these General Terms and Conditions of Messe Offenbach for the visitor ticket shop. Deviating conditions of the customer shall not become part of the contract, even if Messe Offenbach does not expressly object to them. Additional agreements are only legally binding if they have been confirmed in writing by Messe Offenbach. Special regulations do not invalidate the other conditions. The purchase of admission tickets for the purpose of resale is generally prohibited.

1.3 The Customer must be a trade visitor. Trade visitors are resellers of goods exhibited at ILM. Trade visitors must be entrepreneurs within the meaning of § 14 of the German Civil Code (BGB). An entrepreneur is a natural or legal person or a partnership with legal ca-pacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

1.4 The subject of the contract regulated by these Terms and Conditions is the supply of tickets for ILM/ILMv of Messe Offenbach.

2. Contract conclusion

2.1 When the ticket is purchased via the visitor ticket shop, a legally binding contract for the visit to ILM and ILMv is concluded between the Customer and Messe Offenbach.

2.2 After the purchase, the customer receives his ticket by e-mail. The customer can print and/or save the ticket. The ticket is also valid as a receipt.

3. Prices and terms of payment

3.1 The prices stated in the visitor ticket shop include the statutory VAT and all other price components.

3.2 Payment shall be made by the customer via PayPal or by credit card (Visa Card, Master Card). All amounts are due for payment immediately and without deduction upon conclu-sion of the contract. An external service provider is used to process the payment. Your credit card or PayPal account will be debited upon order confirmation.

3.3 If payment is subsequently rejected, Messe Offenbach will block the tickets for access to the respective event.

4. Shipping and printing

4.1 When ordering, tickets for the ILM/ILMv are provided in the variants "print@home ticket" (tickets can be printed out and/or saved) and "mobile ticket" (for the smartphone). The tickets can also be accessed at any time in the customer account.

4.2 In the event of loss and/or misuse of the ticket, the customer shall not be entitled to at-tend the event or to a refund of the ticket fee.

5. Revocation

The revocation of the contract is excluded. In principle, there is no entitlement to the return of the ticket. If a ticket has been taken back due to cancellation of the event, the return and refund of the purchase price will only be made against return of the ticket up to 4 weeks after the scheduled date of the event. 6. Access and validity

The ticket (printed out or on the smartphone) is scanned via a QR code scanner when entering the ILM. The customer shall ensure that the ticket is carried at all times.

The ticket loses its validity when leaving the venue. Exceptions to this are tickets that explicitly allow access on several consecutive days and tickets for ILMv.

7. Image and Audio Recordings

For all known and unknown types of use in all media, the customer consents free of charge and without any temporal or geographical restrictions to Messe Offenbach or third parties commis-sioned by Messe Offenbach being entitled to make image and/or sound recordings of the cus-tomer in the context of the ILM and to use, process and reproduce, distribute, exhibit, make pub-licly accessible and archive such recordings in whole or in part for editorial reporting and for marketing and advertising purposes for the event on a non-commercial and commercial basis.

8. Liability

Messe Offenbach shall be liable without limitation for damage suffered by the customer only insofar as such damage is attributable to its intentional or grossly negligent conduct.

8.1 In the event of slightly negligent breaches of duty, Messe Offenbach shall only be liable for the breach of one of its essential contractual obligations (cardinal obligation).

8.3 Messe Offenbach does not guarantee that the operation of the visitor ticket shop will be un-disturbed by interruptions or errors. It will endeavour to keep the operation of the Ticket Shop free of errors and interruptions as far as this is technically possible. Messe Offenbach also does not guarantee that the website of the visitor ticket shop is free of viruses or other disruptive agents. Liability is therefore also excluded.

9. Data privacy

9.1 Messe Offenbach shall process the personal data of customers in compliance with the relevant data protection provisions. Personal data (in particular name, address, telephone number, e-mail address, credit card details, etc.) shall be collected, processed and used by Messe Offenbach to the extent necessary for the establishment, structuring, amend-ment or fulfilment of the contractual relationship.

9.2 Messe Offenbach shall be entitled to transfer the data to third parties commissioned by it to execute the contract, insofar as this transfer is necessary in order to fulfil the contract for attendance at the event or in order for Messe Offenbach to be able to offer further ser-vices in connection with the event. External service providers and contractual partners who use personal data of customers on behalf of Messe Offenbach are also obliged to maintain confidentiality.

10. Any Other Terms and Conditions and Severability Clause

Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision which comes as close as possible to the economic purpose of the invalid provision in a legally permissible manner. The same shall apply to the filling of any gaps in the contract.

The provisions of German law shall apply exclusively.

The place of performance and jurisdiction for all mutual obligations shall be Offenbach am Main only.

The law of the Federal Republic of Germany shall apply.
